available is changing and for expats and digital nomads, that difference matters. The latest data shows that remote work has stabilised rather than declined. Around <strong>22\u201323% of workers<\/strong> now telework regularly, representing <strong>34\u201335 million people<\/strong>, and about <strong>25% of all paid workdays<\/strong> are done from home, which is <strong>three times higher than in 2019<\/strong>. <em>(Source: BLS, Gallup, WFH Research, 2024\u20132026 syntheses)<\/em><br\/>However, the structure of remote work has shifted. Among <a href=\"https:\/\/coach4expats.com\/nl\/\">jobs that can be performed remotely<\/a>, <strong>hybrid has become the dominant model<\/strong>, with <strong>51% hybrid<\/strong>, <strong>28% fully remote<\/strong>, and <strong>21% fully on-site<\/strong>. Courts routinely look at where the work is <em>habitually performed<\/em>:<br\/>Legal guidance on digital\u2011nomad contracts emphasises that applicable employment law is usually determined by where the work is primarily performed, not just the contract wording; e.g. a UK\u2011employed worker who mostly works from Portugal may fall under Portuguese labour law.\u200b<br\/>This affects notice periods, termination protections, working\u2011time rules, and mandatory benefits, often making dismissals harder or more expensive for employers.<br\/>This \u201chidden\u201d local law application is one reason some employers now restrict \u201cwork from anywhere\u201d and push people back into the country where the entity is based.<br\/>\u00a0<br\/><strong>Tax and social security complexity<\/strong><br\/>Cross-border remote work can create unexpected tax and social security risks:<br\/>Employees working abroad for <strong>183+ days<\/strong> may become tax residents and create <strong>permanent establishment risks<\/strong> for their employer.<br\/><br\/><br\/><strong>EU telework frameworks<\/strong> now regulate cross-border work. For example, the Luxembourg-based agreement applies when employees work <strong>25\u201350% remotely from their residence country<\/strong> and requires formal social security declarations.<br\/><br\/><br\/>Cross-border remote setups (workations, international remote work) are increasing, but so is <strong>regulatory scrutiny<\/strong>, with <strong>fines up to \u20ac1,000,000<\/strong> for serious non-compliance.<br\/><br\/><br\/>Since <strong>July 2024<\/strong>, retrospective <a href=\"https:\/\/europa.eu\/youreurope\/citizens\/work\/social-security-and-benefits\/social-security-forms\/index_en.htm\" target=\"_blank\" rel=\"noopener\"><strong>A1 certificates<\/strong> in the EU<\/a> can only be issued <strong>up to three months back<\/strong>, exposing earlier periods to unexpected social security liabilities.<br\/><br\/><br\/><strong>Implication:<\/strong> What seems like a simple <a href=\"https:\/\/coach4expats.com\/nl\/ondersteuning-bij-het-zoeken-naar-een-baan\/\">\u201cwork abroad\u201d<\/a> arrangement can quickly turn into a major compliance risk, making office return or workforce centralisation more attractive for risk-averse employers.<br\/><strong>Immigration and visa status<\/strong><br\/>For digital nomads and many expats, immigration status is fragile:<br\/><strong>Legal guides emphasise that tourist visas do not authorise work<\/strong> \u2013 even remote work for a foreign employer; digital nomads are supposed to have either appropriate residence status or a dedicated digital nomad visa.\u200b<br\/><strong>European digital\u2011nomad visas (Portugal, Spain, Italy, Croatia, etc.) typically require:<\/strong> a <a href=\"https:\/\/coach4expats.com\/nl\/online-training\/\">remote contract with a foreign employer<\/a>, minimum income, health insurance, and a clean criminal record.<br\/>If an employer cancels a remote arrangement and insists on in\u2011office work in another country, a nomad may suddenly be out of legal status (no job \u2192 no visa) or forced to leave their current host country.<br\/><strong>Net effect:<\/strong> Employers see cross\u2011border remote as a compliance, tax and immigration risk;
